家庭电话来电显示涉及发话方和受话方多种权利的冲突。逻辑上看,对发话方和受话方隐私权的讨论,首先要研究的是发话方的信息交流权与受话方的知情权之间的冲突或平衡。信息交流的双方互动性决定了信息交流权对知情权的从属性,从而决定了受话方隐私权保护的优先性,进而表明了来电显示装置的正当性。
Caller ID involves the conflict of various rights between the caller and the call recipient. This article, based on the case law and legislation concerning Caller ID in the United States, examines the jurisprudential basis of Caller ID, focusing on the calling party＇s right of communication and the called party＇s right to know who the calling party is, and analyses the conflict and balancing of rights between the two parties.
