法社会学视野中的程序正义

Procedure Justice in the View of Sociology of Law

程序正义是现代社会中受到广泛关注的重要问题。一般而言,对于此问题的研究存在两种进路:规范性的和描述性的。规范性程序正义理论是我国程序正义研究的主要理论资源,这种研究进路虽然具有重要的价值,但同时也存在难以回答的问题。而法社会学对于程序正义的描述性研究有助于克服这些问题,并可以加深我们对程序正义的认识和理解。

Procedure justice is a very important issue in the modem society. Generally there are two study paths leading to this issue： normative way and descriptive way. The normative theory is the main source of China＇ s study of procedure justice, this approach has great value, and also confront with some problems. The descriptive one which used by the sociology of law will be helpful to solve this problems and deepen our perspective of procedure justice.
