The Legalization Process of Family Planning In Modern China

1978年以来,我国计划生育法制建设大体经历了三个发展阶段:计划生育被写入《宪法》及相关法律,是计划生育的法制化滥觞;计划生育地方性法规、行政法规和部门规章,在计划生育立法实践中起着承前启后的重要作用;而《中华人民共和国人口与计划生育法》的颁布与实施,则标志着我国计划生育走上了全面法制化的轨道。

Since 1978, the legal system construction of China＇s family planning has generally undergone three stages. First, the policy of family planning was enunciated in the Constitution and related laws were established, which started the legalization of family planning. Secondly, local, administrative and department regulations of family planning were set up, which functioned as a link in the legislative practice. Finally, The Population and Family Planning Law of the PRC was promulgated and implemented, which marked the all-round legalization of China＇s family planning.
