知识经济条件下知识产权与反垄断法关系新特点探析

Analysis to the New Characteristics in the Relationship between Intellectual Property Rights and Anti-trust Law under the Circumstance of Knowledge Economy

知识产权与反垄断法之间关系的定位问题,是知识产权垄断法律控制制度构建中首先要解决的理论问题。一般认为,知识产权和反垄断法的关系可简单概括为功能上的互补性和方法上的冲突性。但基于不同历史阶段经济发展的不同特点以及人们的主观认识差异,法律实践中对二者关系的关注程度和对两者关系中冲突性或互补性的强调程度是不同的。知识经济条件下知识产权与反垄断法之间的关系较之以往受到更多的关注,并呈现出三方面新的特征:强调知识产权与反垄断法的功能互补性;关注反垄断法对知识产权领域中新的垄断行为的规制;尝试通过确立新规则解决知识产权领域的垄断问题。

The definition of the relationship between intellectual property right and anti - trust law is the first theoretical issue to be solved in the construction of anti - trust law in intellectual property rights. It is the general understanding that this relationship can be simply summarized as functional complement and conflicts in method. However,with different economic situation in different history, and different subjective opinion, they two are always treated differently in legal practice. In the stage of knowledge economy, the relationship have got more attention than before, presenting three new characteristics： to emphasize the functional complement between intellectual property and anti -trust law;to pay more attention about the new monopolistic activities in intellectual property right regulated in anti -trust law;to attempt to solve the anti -trust problems in intellectual property right with new rules.
