摘要
韩国国家人权委员会根据"国家人权委员会法"的第19条、第30条、第42条等条文,履行对平等权的保障义务。国家人权委员会对国家机关侵害平等权的行为通过劝告等形式发挥保障作用。但是国家人权委员会对国家机关不遵守或不履行其劝告事项却无权实施强制措施。所以,为了提高国家人权委员会劝告的实效性,从制度上需要在各个国家机关内部设置人权政策负责人和人权政策协会,同时两者之间应实现分工协作,以保证国家机关以积极态度接受国家人权委员会的决定。
According to the Article 19,30,42 in the rule of national human rights committee, the Korean national human rights committee fulfills its duty of protecting the rights of equality harmed by national government by means of giving advice. But national human rights committee has no right to enforce its advice once the government shows its unwillingness. Therefore, in order to improve the influence of the advice by national human rights committee, the human rights policy principal and human rights committee should be established from system in each level of government. At the same time, distribution and cooperation must be realized between both to ensure the government accepting the decision from national human rights committee without any reluctance.
