摘要
基于委托—代理理论在代建制中应用,通过构建代建委托—代理模型分析了我国代建制推行过程中由于业主和代建人违约所引起的合同风险问题,针对发现的问题探讨了代建制项目管理方式的合同风险防范机制,提出了代建制的保证担保模式,以期有效地规避了代建工作的风险。
The paper, on the basis of applyment of the principal -agent theory,has analyzed the main problem of contract risk for owner and agent construction company can＇ t obye rules in agent Construction System and has studied the keeping away mechanism of contract risk in Agent Construction System, has established the guarantee assure mode of Agent Construction System, has effectually eluded the risk in Agent Construction System.
