Misjudged case investigation system in criminal field doesn＇t conform to the objective rules of justice and occupational trait. It＇s easy to affect the mentality of the judge and public procurator and affect the criminal justice action further. we should abolish the misjudged case investigation system and absorb the research achievement of the theory of attribute. We should base on the principal of ＂controllability＂ and on the standards of ＂action＂ and ＂procedure＂ to norm the procurator and judicial action and promote the judicial fair realization.
