摘要
《中华人民共和国物权法》对船舶等交通运输工具的物权变动采用了意思主义的物权变动模式,通过对民法上物权变动立法模式的分析及比较法上的考察,中国物权法下船舶物权变动应采取形式主义模式。
Property rights alteration to vessels and other means of transportation in Property Law of the People＇s Republic of China adopts mode of autonomy of the will. However, by analysis of legislation mode of property rights alteration in Civil Law theory and study of Comparative Jurisprudence, it is supposed that the mode of formulism should be applied to property rights alteration to vessels in Property Law of the People＇ s Republic of China.
