摘要
农村土地承包经营权并非均为物权属性。家庭承包方式下取得的初始农村土地承包经营权均为物权属性,其它方式下取得的初始农村土地承包经营权如办理了登记则属物权,未办理登记则属债权。而流转后的农村土地承包经营权的属性则因其流转方式的不同而有所区别。实践中应区分两种不同性质的农村土地承包经营权。
Not all the rural land contraction management rights belong to property attribute. The initial rural land contraction management rights owned by family contract mode and rights by other modes with registration are property attribute,otherwise the rights entiffed by other means have creditor' s attribute. And the attributes of rural land contraction management rights after circulation are different in the different circulation, The two different natures of rural land contraction management rights in the practice should be differentiated to ensure the correct implementation of both property right law and rural land contracted management law.
