流转过程中的农村土地承包经营权法律属性比较

农村土地承包经营权并非均为物权属性。家庭承包方式下取得的初始农村土地承包经营权均为物权属性,其它方式下取得的初始农村土地承包经营权如办理了登记则属物权,未办理登记则属债权。而流转后的农村土地承包经营权的属性则因其流转方式的不同而有所区别。实践中应区分两种不同性质的农村土地承包经营权。
