摘要
认为行政许可的条件不同于行政许可的标准、程序以及申请行政许可需要提交的材料。《行政许可法》关于行政许可条件只作了原则性规定,《城乡规划法》亦未对规划许可条件作具体规定,但其他法律、法规、规章甚至规范性文件对规划许可的前提作规定的情况并不少见,有的属于规划许可条件,有的属于规划许可标准、程序,还有的既属于规划许可条件,也属于规划许可标准或程序。但在上位法已作规定的情况下,下位法只能对规划许可的条件作出实施性规定,不应有任何突破。
This paper argues that conditions of administrative permission are different from its stan- dards and procedures and the materials submitted when applying for administrative permission. The Administrative Permission Law only regulates conditions of administrative permission in principle and the Urban and Rural Planning Law does not regulate conditions of planning permission in detail either. Nevertheless, the preconditions of planning permission in other laws, regulations, rules and even normative documents, some belong to conditions of admin- istrative permission; the others belong to standards and procedures, or both. When superior laws have regulated the conditions, subordinate laws can only regulate the implementation of the conditions of planning permission, and should not exceed their limits.
