浅析紧急避险的必要限度问题

A Simple Analysis of the Limit of Urgent Necessity

紧急避险是为了使国家、公共利益、本人或者他人的人身、财产和其他权利免受正在发生的危险,不得已而采取的损害另一较小合法利益的行为。紧急避险的必要限度涉及一个权衡将要保护的利益与实施紧急避险行为将要损害的利益之间的轻重问题。行为人在必要限度内实施紧急避险行为,因其所保护的利益大于其所造成的损害,其行为具有正义合理性。紧急避险超过了必要的限度造成不应有损害的行为,则有一定的社会危害性。

The urgent necessity is an act being taken forcibly to damage a comparatively smaller lawful interest because the national or public interest, or the interest of an individual＇s body, property or other rights have to be made avoid a present danger. The limit of urgent necessity involves a problem which is to compare the interest to be protected and the one to be damaged. If the actor~ necessity is to be done within the limit and the interest is bigger than the interest to be make an unnecessary damaged damage, , then the act is just and reasonable. If the necessity goes beyond the limit so as to then it will do certain harm to the society.
