On the Issue of Main Body in the Civil Lawsuits against the Running-off of State-owned Enterprise Property

国有资产流失是一个严重的社会问题,直接损害了国家利益。国家为了防止国有资产流失,除采用行政管理的方法外还应采取民事诉讼保护方式。在现行的法律制度,谁是国有资产流失民事案件的原告是一个值得探讨的问题,也是一个司法疑难问题。

The nmning-off of the state-owned property is a serious social problem which directly harms the state benefits. To prevent the nmning-off of the state-owned property, besides the administrative managing measures, civil lawsuit should also be employed. In the present legal system, who should be the prosecutor of the civil lawsuits against the running-off of the state-owned property is a controvertial question worth discussing.
