从未成年人犯罪的特点看现行刑罚制度的缺陷

A Reflection on the Defect of Present Punishment System from the Character of Juveniles Crime

未成年人犯罪作为一种特殊的犯罪类型,具有显著不同于成年人犯罪的特点。对未成年人犯罪的刑事处罚必须充分考虑到这一事实特征。否则,不仅设定处罚措施的科学性将严重受损,而且实践中还会造成高负面效应。现行刑法典的罪刑设计是以成年人犯罪为基调和标准的,未能考虑到未成年人犯罪的特殊性,因而在处罚制度的设计上存在着严重的制度性缺陷。面对未成年人犯罪的严峻性,正视这种局限性的客观存在,理性把握未成年人犯罪的规律和特点并据此形成科学的处罚理念,不仅对司法实践中正确处理未成年人犯罪案件具有现实意义,而且也有助于立法完善时制定出体现对未成年犯罪人特殊司法保护要求的刑事规范。

As a special type of crime,juveniles crime has obvious character different from adult crime.The criminal punishment to juveniles crime must fttlly consider this character. Or else, not only the science character of punishment method will be damaged seriously, but also produce bad influence in practice process. In present criminal code, the punishment system is designed according to the adult crime character, can＇ t consider the speciality of juveniles crime,as a resut,the design of punishment system has serious defect. Face the serious situation of juveniles crime, we must acknowledge this defect, research the character of juveniles crime and establish the scientific punishment notion, not only has signifance to deal with juveniles crime in justice pratice, but also has benefit to make the criminal rules that embody the special demand of justice protection to juveniles crime when legislation pefect.
