摘要
在未成年人刑事案件中,基于未成年人的身心特质、刑罚的个别化原则,对未成年犯罪嫌疑人、被告人开展社会调查,以补足未成年人刑事诉讼程序的非正式性,落实"教育、感化、挽救"的社会政策。在我国现行司法体制和诉讼模式之下,这种社会调查应当适用于刑事诉讼整个过程,作为司法机关办案辅佐者的社会调查主体应由独立于控辩审三方的人员担当;社会调查报告只有在听取诉讼参与诸方的意见之后,才可以作为办案的依据。未来刑事诉讼法修改中,应当明确社会调查的主体及其诉讼地位,规定社会调查报告的运用规则。
In juvenile proceedings, the social investigation should be conducted to Juvenile suspected and accused according to special body and mind. Social investigation helps to realize punishment individualization and the policy of "education, influence and rehabilitation", supplement the informality of juvenile proceedings. In Chinese judicial system and criminal procedure, the social investigation should apply to all procedural stages, the subject of social investigation should be independent on the accused, prosecutor and judge, and social investigation reports should be used after judicial organs heard the opinions of all parties. In the amendment of Chinese Criminal Procedural Law, we should stipulate the subject and status of social investigation and the rules of employment of social investigation reports in juvenile proceedings.
