论我国外资银行法律监管的理念演变

On the Evolution of Ideas for Foreign Bank Supervision

《中华人民共和国外资银行管理条例》的出台,表明我国外资银行的监管理念由原有的单一监管向多元并重监管转化,标志着我国对外资银行的法律监管进入了一个新阶段。但仍有必要从明确多元化监管目标、注重事前监管与事后监管的相互结合、加强对银行法律监管的国际合作、强化功能监管在整个法律监管中的地位与重视现代监管技术的运用等方面更新银行法律监管理念。

With the Regulations of the People＇ s Republic of China for the Administration of Foreign Banks being released, it shows that supervisional ideas in China is transferring from the single-direction supervision to the multi-direction one, which marks foreign bank supervision in China has stepped into a new stage. However, with the development of financial liberalization and globalization, it is still necessary to update new supervising ideas which include defining the diversified goals of supervision, emphasizing the relations between antecedent supervision and post supervision, strengthening the international cooperation of legal supervision, attaching greater importance to functional supervision and placing emphasis on the application of modern techniques in supervision.
