论我国刑法共同犯罪中止理论之完善

On the Perfection of the Joint Offense Discontinue Theory in Our Country's Criminal Law

共同犯罪与犯罪中止是犯罪构成结构和犯罪过程中的特殊形态,二者并存时就产生了所谓的"共同犯罪的中止"问题。我国目前的犯罪中止理论是就单人犯罪而言的,实践中关于共同犯罪中止的认定往往引发颇多争议。本文通过借鉴和吸收主观主义、客观主义和折衷主义等国外共同犯罪中止理论的优点,认为在把"脱离共犯关系说"作扩大解释的基础上,借鉴"因果共犯论"来解决此难题,不失为完善我国刑法上的共同犯罪中止理论之可能路径。

Joint offense and offense discontinue are the special form of offense constituting structure and in the course of offense. While both the two co -exist will produce the so- called ＂joint offense discontinue＇question. The present offense discontinue theory of our country is called in respect of individual offense; in practice, with regard to this question there often arise quite many arguments. This note, through borrowing and absorbing from the foreign advantages such as subjectivism, objectivism, eclecticism about this question, holds that it is a possible way of perfecting the joint offense discontinue theory in our country~ criminal law to solve this difficult question by taking ＂the theory of gettingride of joint -offense relation＂ as the foundation of expanding explanation, and borrowing ＂cause and effect joint - offense theory＂
