在当前死刑存废之争中,关于死刑是否具有最大的威慑力,是理论争议中一个重大的问题。死刑具有难以否认的、与生俱来的、固有的客观威慑力,却不一定具有最大的威慑力。过度适用死刑和过度强调其威慑力,都可能适得其反。

In the present controversy about the maintenance or revocation of death penalty, the major problem is whether the death penalty has supreme deterrent. The death penalty has intrinsic objective deterrent which is hard to deny, but not certainly supreme. Both excessive application and overemphasizing the deterrent of the death penalty may be just the opposite to what we wish.
