医疗纠纷民事责任的法律适用

侵权之诉的医疗事故损害赔偿纠纷应适用《民法通则》相关规定和《关于审理人身损害赔偿案件适用法律若干问题的解释》,并参照《医疗事故处理条例》加以处理;违约之诉的医疗损害赔偿纠纷案件应适用《民法通则》、《合同法》,同时也可参照《医疗事故处理条例》加以处理;对于医疗机构提供的药品、医疗器械、日用品等和具有商业性质的服务如餐饮、住宿等发生的纠纷应适用《消费者权益保护法》加以处理。在医疗事故人身损害案件中,法律适用的二元制体系,有其合理性的一面。

Infringement damages against the medical malpractice disputes should be applied to＂ General Principles of Civil Law＂ ,and to be addressed in the light of ＂ regulations＂ ;Breach of medical damages dispute cases should be applied to＂ General Principles of Civil Law＂ ,＂ Contract Law＂ , but also the light of the＂ regulations＂ ;For medical institutions to provide medicines, medical equipment and other necessities and commercial nature of the services such as catering, accommodation in the dispute should be applied to＂ Protective law of Consumers＇Rights＂. In medical malpractice of personal injury cases, the law applies to binary system.
