Poem and True:A New Interpretation on Radbruch's Jurisprudential Turn

拉德布鲁赫的前期学术思想与后期学术思想之间,被认为存在一种根本性的"转向"。这一"转向"是否真的存在,是当代法哲学的重要命题。本文认为,把拉德布鲁赫在法实证主义和自然法之间的相对性夸大为"转向",将拉德布鲁赫法哲学人为地割裂为前对后错或前错后对的两段,不但会低估拉德布鲁赫在实证主义和自然法之间寻求新道路的努力,降低拉德布鲁赫法哲学应有的贡献度,而且包含着的形而上学本质主义观念,也值得我们及时认真地清理。

There is definitely a great jurisprudential question that,as some scholars believed,in Radbruch's later thinking there is a certain sharp turn relative to his early thinking.This article argue that it's maybe a kind of exaggeration if not a mistakenly apprehension when we divided Rudbruch's idea metaphysically up to two alternative parts.The author try to testify that Radbruch made great contribution in finding a new way toward relax the tension between legal positivism and natural law..
