我国刑事立法中的伦理性反思

The Ethical Reflection on the Criminal Legislation of Our Country

虽然我国的刑事立法日益完善,但犯罪率却只升不降,究其原因,在于我国刑事立法的伦理性缺失。以社会伦理性原则为指导,分析犯罪、刑罚与伦理的关系,发现我国现今刑法典中某些条文缺失伦理性,刑罚的种类与适用缺乏人道性。

Though our country＇ s criminal legislation is perfect day by day, still the crime rate increases;the reason why lies in the ethical lacks in our country＇ s criminal legislation. It is discovered that in the present penal code of our country some articles lack ethical nature and in the kind and applicability of the punishment there are short of human nature.
