摘要
在我国,大学生如果因刑事犯罪被处以刑罚,或者因严重违法被处以治安管理处罚,往往就会被高等学校给予开除学籍处分。社会惩戒与学校惩戒衔接有其必要性,但是当前制度中存在严重弊端。高等学校应当充分考虑到学生的实际情况,尽最大可能保障其受教育权,慎用开除学籍处分。
If the students were punished because of the criminal offence or serious irregularity in China, they always were expelled from the high school. It is necessary to connect the society disciplinary and the school disciplinary. But the high school should think about the students＇ practicality circus, protect the right of education and be charity of using the punishment.
