当前日本已经实现了循环经济法治化,而中国循环经济的发展才刚刚起步,循环经济法律制度还很不完善,特别是循环经济法的缺失,难以运用权威的法律手段保障和引导循环经济的持续发展。因此,通过借鉴日本循环经济立法的成功经验,确立适合中国国情的循环经济法基本原则,构建循环经济法在生产建设、流通消费、激励支持等环节的特有法律制度是解决这一问题的路径选择。

Now, Japan has realized the legislzation of circle economy. But in China, the development of circle economy is still in its beginning stages, The law system is not perfect, especially the circle economy law. So, we can draw lessons from the successful experience of Japan＇s circle economy legislation, set up the suitable principle of circle economy law, construct the special law system of circle economy law in links of production construction, circulation consume and excitation support.
