广州地区女性精神障碍者被性侵害案鉴定特点分析

Case analysis of sexual assault against female mental disorders in Guangzhou

目的探讨发生在广州地区女性精神障碍者被性侵害案的特点,为预防此类事件的发生及维护这类妇女群体的权利提供参数。方法自制调查表对要求进行性自我防卫能力评定的91例女性精神障碍者相关因素进行分析。结果(1)在被性侵害的女性精神障碍者中以精神发育迟滞(73.7%)及精神分裂症(14.3%)的患者最多见;躁狂状态占5.5%;其他占6.5%。(2)性自卫能力丧失者(80.2%)明显多于性自卫能力削弱者(13.2%)及性自卫能力存在者(6.6%)。(3)无性防卫能力者以中度精神发育迟滞最多(51.8%),其次是轻度精神发育迟滞(23.2%);中度、重度精神发育迟滞及伴有其他异常者全部为无性防卫能力(100.0%);轻度精神发育迟滞者中以无性防卫能力的比例最高(56.5%)。(4)案发地点以受害人自家(24.2%)、犯罪嫌疑人家(34.1%)以及空地或偏僻处(28.6%)为多。受害者家住异地的占63.7%;案发地在乡村的70.3%。结论女性精神障碍者被性侵害案例有其自身特点,应特别注意加强轻、中度精神发育迟滞及精神分裂症患者的监护。

Objective Initial study of cases of sexual assault against female mental disorders in Guangzhou district and parameters provided for precaution of sexual assault against female mental disorders as well as protection of interests and rights of those concerned. Methods Analysis of related factors of 91 female mental disorders requiring for appraisal of self-defensive ability with the help of self-made investigation forms. Results In cases of sexual assault against female mental disorders, mental retardation accounts for the largest proportion of 73. 7%, schizophrenia accounts for 14.3%, mania accounts for 5.5%, and others accounts for 6. 5%. Among all those victims, 80. 2% have lost sexual self-defensive ability, 13.2% are in reduction of sexual self-defensive ability, and 6.6% still have sexual self-defensive ability. Most of the cases happened at the home of the victim （24. 2% ） or the home of the accused （34~ 1% ）, or the by-place （28. 6% ） . The home of victim reside in other district accounted for 63. 7%. Many of these occurred in countryside （70.3% ）. Conclusion Case of sexual assault of female mental disorders has its own characteristics. Monitoring the patients of mild or moderate MR or schirophrenia is essential.
