公司法人所有权的提出是对传统所有制及其《物权法》的突破。公司尤其股份有限公司作为社会化企业,突破了传统私有制和公有制的束缚,形成了一种全新的社会所有制。它在很大程度上不仅克服了传统私有制的不足,而且也解决了传统公有制的缺陷,这是西方发达国家的"明显稳定性"及其强劲发展势头的重要因素。这一点是传统马克思主义理论所未预料到的。对于后发性的发展中国家的中国,不应当重走西方国家资本原始积累的发展阶段,也不应当重走前苏联东欧国家等后共产党经济中所出现的非法的和半合法的私有化,否则我们永远滞后于人并重演历史悲剧。公司作为社会化企业,足以让我们对传统的私有制和公有制进行反思,走出适合中国国情的现代化道路。

Advancing a viewpoint of corporate ownership of company breaks through traditional ownership system and law relating to rights over things. Company, such as company limited especially, which is a kind of socialized enterprise, breaks through a restriction of traditional private ownership and state ownership, and forms a new kind of social ownership, which not only overcomes the weakness of traditional private ownership, but also solves the defect of . traditional state ownership in a great extent. It is a important factor promoting the obvious stability and rapid development of the western developed countries which hasn＇t been forgseen by traditional Marxist theory. China, as a developing country, shouldn＇t not only return a developing period of capital original accumulation of the western countries, but also go back a road of the Soviet Union and East European countries which appear the illegal and semi-legal private exercises in the late-Communist Party＇s economic period. Otherwise we will fall behind the other countries forever and repeat the historical tragedy. Company, as a socialized enterprise, is enough to make us think about traditional private ownership and state ownership, which can make China form a modernized road basing ourselves on China＇s national conditions.
