摘要
分析了二战以后国际人权表现出来的与传统人权显著不同的外在特征。这些特征具体表现为:主体的多元性、内容的具体性和保障的实效性。指出了传统人权观念的固有缺陷:"人权"在不同权利主体之间利己的争斗中窒息了;后现代主义法学对人权观念的影响,即强调人权的整体性与和谐性。在此基础上,指出了和谐成为国际人权的内在精神。和谐是人权彰显自身价值的必备品格,它调和了不同人权价值观的对立,使得国际人权合作成为可能。
This paper illustrates that after World War Ⅱ the International-human rights has remarkably different external features compared with the traditional human rights: the diversity of subject, the concrete character of content and the effectiveness of protection. It points out the deficiencies of traditional human rights concept: "Human rights" stifles in the self-serving fight between different right subjects, and the influence exercised over human rights concept by Post-modernism legal theory, which emphasizes the entirety and harmony. Based on this, it concludes that harmony has become the inherent spirit of International human rights, harmony is the essential character of human rights to show Its own values, and it reconciles the confrontations between different values of human rights, and makes international cooperation on human rights possible.
