中国社会正处于转型期,同质性日益瓦解,各种纠纷繁复,这就使得单一化纠纷解决机制不可能满足社会需求,其内在的弊害也日益呈显。构建多元化纠纷解决机制是当今国际社会的通行做法,也是当下中国的必然选择。其深层原因可以通过下述现象得以透视:社会批判理论对现代性和现代法治的反思、真理观上由"符合论"向"共识论"的转变以及追求"无讼"和注重"调停"的传统文化的影响。深度探究其所倚赖的内在成因机制,对当下的法治建设和多元化纠纷机制的建构无疑具有宏观的指导意义。

China＇s society is experiencing transformation and the homogeneity is weakening gradually. All kinds of disputes have arisen with complexity, which makes mono-dispute resolution system out of date and the drawbacks more conspicuous. To construct Mtemative Dispute Resolution （ADR） is the common practice in the world and is also the desirable choice of China. The call for ADR is caused by the following aspects： the reflection of social critical theory on the modernity and modem practice of rule of law, the transfer from compliance to consensus, and the influence of traditional culture. A profound probation of the causes will be of macro-significance for the construction of the rule of law and ADR.
