针对海上保险代位追偿案件中的诸多争议,从分析代位追偿制度的法理基础与法律属性的角度入手,探寻构建海上保险代位追偿制度的相关标准,并以此为指引,解决若干争议问题,以实现代位追偿制度之本意与目的。

In view of disputes arising from marine insurance subrogation in many controversial cases, this paper starts with an analysis from the perspective of the legal attributes and, based on the subrogation recovery legal system, tries to set up related standards, seeks to solve certain contentious issues, with a view to realizing the original purpose of subrogation recovery system.
