摘要
通过比较英美法系和大陆法系主要国家、地区法律规范的不同规定,并参阅英美法系国家一些的海事判例,从多个角度分析"买卖不破租赁"原则在二手船买卖中的应用问题,指出民法的大多数原则并不都是当然可以应用在海商法中,海商法也并不仅仅是民法的特别法而已。
The author researches the topic of the application of the principle of ＂sales can not devastate lease＂. By comparing different laws and regulations of common law countries and civil law countries in connection with this topic, and by analysis of the representative cases thereof, the author analyzes this topic in several degrees. The conclusion is that not all the principles in civil laws can be absolutely applied in maritime law.
