当代基因科技发展的负面效应与我国基因科技法的基本制度——兼论我国基因科技立法应遵循的基本原则

Side-effect of the Development of Genetic Technology with China's Regulations on Genetic Technology: The Doctrine of China's Genetic Technology Law

当代基因科技获得了飞速发展,但同时也引发了诸多负面效应。为此,基因科技立法须遵循风险预防的立法理念,并在此理念的指导下进行基本制度设置。在我国基因科技立法过程中,应遵循经济立法、超前立法及科学立法3项基本原则。

The genetic technology develops fast, which brings about much side-effect. Venture precaution should be followed during the genetic technology legislation and the regulation of the genetic technology law should be established by the doctrine of venture precaution. During the legislation of China＇s genetic technology law, three principles should be abide by which are economically, predictionally, and scientificly.
