“参与治理”理论在失地农民保护中的运用

On the Application of Particiption Theory in the Protection of Plowland-lost Farmers' Rights

参与治理制度作为社会治理的一个重要途径而得到广泛推荐,是对经济人假设理论不足的有效弥补,是对失地农民有力的保护手段。应当运用参与治理理论来构建我国失地农民保护制度,促使征地程序公开,保障农民参与,引入征地目的合法性,征地补偿司法审查程序,实现失地农民参与治理制度从内容到形式趋于完善。

Participation in the system of governance is widely recommended as an important way of social governance, an effective make-up for the economic theory of the lack of effective remedy, and a forceful＇ protective method for the land-lost farmers. It is suggested that participation theory should be applied to the construction of China＇ s lost-land farmers＇ protective system, therefore, to make public the land requisition procedure, to ensure farmers＇ participation, to legalize the aim of land requisition, to realize the land compensation judicial review procedures, thus to make mature land-lost farmers＇ participation in the governance.
