论社会转型时期人民调解制度的完善——以“诉调对接”为视角

On the Improvement of People’s Mediation in the Conversion Period of the Society——From the Perspective of Docking Litigation and Corciliation

人民调解是我国民间调解的法定活动形式。它在解决纠纷、预防纠纷、减少诉讼以及维护社会安定方面曾发挥过重要作用。进入20世纪90年代以后,随着社会主义市场经济体制确定,它的作用日益下降。文章以"诉调对接"为视角,从三个方面,即人民调解的现状,人民调解制度作用日益下降原因以及完善之对策等进行了分析,这种分析对人民调解制度的完善将产生重要的影响。

People＇s mediation is the form of the legal activity about civil mediation. It has played an important part in settling disputes, keeping disputes, reducing disputes and maintaining social stability. When it came into the 1990s, its＇ role has declined with the determination of the socialist market economy. This essay analyses the current situation of people＇s mediation, the reason of the effects decline about people＇s mediation and the countermeasures of improvement from the perspective of docking litigation and conciliation. These analyses will make great difference to how to improve the people＇s mediation system.
