摘要
文章通过一个案例分析,探索用人单位内部规定合法性的标准。认为评判用人单位内部规定是否合法,不但要考虑规定的内容是否违反法律强制性条款,程序是否符合法律要求,而且要考察该规定的内容、程序是否具有合理性。同时建议用人单位在制定内部规章时,应当充分考虑劳动者的利益,听取劳动者的意见,降低其内部规定被认定无效的法律风险。
By analyzing a case, this article tried to find the legal standards of Employing labor regulation in unit. There are two factors in arguing the validity of Employing labor regulation :the legality of regulation's contents, as well as the reasonableness of regulation's process. The author suggested that Employing Unit should listen to laborers carefully and think over laborers' interests before they formulated their labor regulations, so that they could decrease the risk of invalidity.
