摘要
不确定的法律概念是法律中无法避免的客观事实,其生成不仅是由于语言本身的模糊性、多义性和不可定义性,也是语言本身的高度抽象性所致,更因为是立法者对于所要规范的事项无法完全预见,为了涵盖更广的规范对象,为了适应社会的变迁,或者是为了权力斗争及妥协的需要,而特意使用的相对模糊的概念形式。
The imprecise legal concept is a legal phenomenon that cannot be avoided. More than because of the language＇s fuzziness, the polysemy, un-definition, and highly abstract, it produce from the legislator＇s unable to completely to foresee the things he wants to normalize. In order to cover a broader standard object and in order to adapt society＇s vicissitude, or for the sake of the conflict of authority and the compromise and uses the relatively imprecise form of concept intentionally.
