论产品责任中纯经济损失有限赔偿规则之确立

Establishment of Limited Compensation Rule about Pure Economic Loss in Product Liability

纯经济损失近年来成为侵权法领域的焦点话题。学者们在对纯经济损失是否赔付的问题上存在着很大的分歧,在产品责任这一特殊侵权领域同样如此。但是无论从历史视角、法经济学视角还是价值视角来看我国立法对产品责任中纯经济损失确立有限赔偿的规则是十分必要的。而问题的关键在于确立合理的限制赔偿范围的工具和限制赔偿数额的方法。

Pure economic loss has become a central topic in tort law recently. Scholars have a great divergence about whether pure economic loss should be compensated , and it also can be applied in product liability. From the perspectives of history, law economics and value, this paper points out that it＇s necessary for our legislation body to establish a limited compensation rule of pure economic loss in product liability in China. However, the key issue is to provide reasonable tools of limiting compensation scope and ways to limit compensation amount.
