A Tentative Discussion on the Design of Parliament's Power in "Provisional Constitution"

《临时约法》在北洋军阀统治时期的地位等同于宪法,国会的同意权、弹劾权、制宪权等职权也是依照《临时约法》而来。立法者的本意是以此限制行政权力,保障民主共和制度。然而,现实的运作却产生了并不理想的结果。

＂Provisional Constitution＂ has the similar position to the constitution in the rule of Beiyang Warlord. According to the ＂ Provisional Constitution＂, the parliament has the power of agreement, impeachment, making constitution and so on. The aim of the person of making ＂Provisional Constitution＂ is to limit the administrative power and to secure democratic republican system, while the result is unsatisfactory.
