印度军事法的历史演进经历了四个前后相继的阶段,即古代时期的萌芽阶段、中世纪时期的发展阶段、东印度公司和英国殖民时期的转型阶段以及独立后时期的现代化阶段。中世纪之前的印度军事法带有鲜明的宗教和习惯法色彩。自印度进入英国殖民统治期间以来,印度军事法打上了深深的英国殖民的色彩,军事法律规范以及军队组织模式依循英国的路径。现代印度军事法尤其是军事立法、军事司法仍然带有明显的英国印记,军事指挥官在军事司法体制中起着至关重要的作用。

The historical evolution of Indian military law has experienced four successive stages, namely the ancient period of infancy, middle Ages stage of development, East India Company and British colonial period of transition stage and in the post - independence period of modernization stage. Before the middle ages Indian military law has the bright religion and the common law color. Since England colonial rule period of India, the Indian military law has gotten the deep colonial color of England, and the military legal norms and the army＇ s organizational model follow Britain path. Modem Indian military law, in particular the military legislation, military justice still had the obvious English mark, and the military commander plays a crucial role in the military judicial system.
