摘要
烟草品牌延伸广告是烟草商规避已有法律禁止性规定,间接为烟草产品做广告的一种手段。本文分析了烟草品牌延伸广告的特点,介绍了欧盟及主要成员国禁止烟草品牌延伸广告立法的概况。在我国已批准世界卫生组织《控制烟草框架公约》的背景下,笔者提出借鉴欧盟及主要成员国的相关立法,借以完善我国现有法律法规的若干建议。
Brand-stretching advertisement is a means by tobacco producers to evade compulsory legislations on tobacco products. In this article, the authors analyze features of the brand-stretching advertisements, and then introduce the corresponding legislations by the EU and its main member countries. With references to those legislations and in the background of China' s ratifying the Framework Convention on Tobacco Control, the authors put forward advice on the perfection on corresponding legislations in China.
