《中华人民共和国反垄断法》(简称《反垄断法》)多年磨一剑(从国务院1987年成立反垄断法规起草小组、草拟《禁止垄断和不正当竞争暂行条例草案》起为20年,自1994年八届全国人大常委会将《反垄断法》列入立法规划为13年),于2007年8月30日颁布,并将于今年8月1日起正式实施。该法的颁行,是中国市场经济法治建设暨中国经济法发展史上具有里程碑意义的大事,对于保护市场公平竞争,提高经济运行效率,维护消费者利益和社会公共利益,促进社会主义市场经济健康发展意义深远。为准确把握我国《反垄断法》的特点、价值追求与颁行意义、作用,厘清《反垄断法》与产业政策、行业监管等相关法律制度的关系,本刊特约请国内有关反垄断法方面的专家、学者就相关问题进行解读,以飨读者。

People's Republic of China Antimonopoly Law,Antimonopoly Law in short,which was enacted on Au- gust 30th 2007,will take effect on August 1st this year.Actually,the birth of Antimonopoly Law came after a long way of halting steps,in that it takes 20 years since 1987,when the State Council founded the Antimonopoly Law drafting committee and enacted Prohibiting Monopoly and Unfair Competition Temporary Regulation Draft,and it takes 13 years since 1994,when Antimonopoly Law was included in the legislation program of the Eighth session of Standing Committee of the National People's Congress.The enact of Antimonopoly Law is an important milestone of the legal construction of Chinese market economy and the history of Chinese economic law development,since that it has significant influence to protect the fair market competition,to enhance the economic operating efficiency,to maintain the consumer benefit and the social public interest,and to promote the healthy development of socialist market economy.Under such background, the journal specially invites some experts and scholars in this area to discuss correlated questions,so as to properly un- derstand the characteristics,the values,the significance,and the functions of Antimonopoly Law,and to recognize the correlation among Antimonopely Law,industrial policy,industrial supervision,and other related legal systems.
