摘要
"形象权"在我国还是一个新的概念。从"刘翔诉《精品购物指南》案"说起,引出形象权的概念,介绍运动员形象权价值实现的基础和方式,并研究了现行法律对运动员形象权的保护以及保护的不足之处,最后提出运动员形象权保护的几点建议。
"The Right of Publicity" is a new idea in China. Taking the case of "Liu Xiang versus Life Style" as a typical example, this article discusses the concept of the publicity right, introduces the foundation and mode of the publicity right of elite sportsmen, and studies the relevant laws and regulations to the publicity right of elite sportsmen. At last, this article puts forward several suggestions on protecting the publicity right of elite sportsmen.
