台州法律文化及法治现代化初论

An Initial Discussion of the Legal Culture and Modernization of Nomocracy in Taizhou City

法律文化是法治的内在表现和重要力量,也标志着法律调整各种社会关系的功能和程度,标志着法律意识形态的发展水平。在中国整体法律文化之下的台州法律文化,在其历史积淀和现代因素下,显现出冲突的个体法律心理,注重习俗和调解的"乡土法治"特点,以及民主权利伸张的重大变化要求。

The legal culture is inner expression and important power of nomocracy system. It indicate the functions and intensity of adjusting different social relationships by law and reflects the development level of legal ideology. Taizhou legal culture, as one part of the comprehensive legal culture in China, has been influ- enced by historical factors and modem factors. Thus, it features conflicting individual legal psychology in conflict, which presents the characteristics of haling by native law＇such as focusing on customs and conciliation and the requirements of the major changes in the extension of democratic rights.
