摘要
工伤已经成为任何一个社会都无法回避的现实问题。发生工伤事故后,工伤保险和民事侵权如何适用?这涉及到社会保险和民事侵权两个法律领域,对此,各个国家有不同的做法,也有很多人作了不同的论述。对工伤保险和民事侵权的法律适用问题,应该区分侵权行为的来源,采用不同的适用模式。
Industrial injury has become the inevitable problem of the society. How to apply the low to the industrial injury insurance and tort after industrial accident.9 The question refers to the filed of social insurance and tort. Different country has different solution to the question and many scholars make different exposition. The article discusses the legal application of industrial injury insurance and tort by analyzing legal relations in industrial accident and aim for legislation of industrial injury insurance and tort.
