摘要
对侵权法与责任保险的功能进行比较,分析各自的特点、缺陷和相互之间的影响。认为责任保险对侵权法的影响是有一定限度的,侵权法在新的时期要继续完善自身体系以满足社会发展的需要。
The functions of the liability insurance and the tort law are compared; their characteristics, defects and impact are analyzed. It is considered that the impact that liability insurance engenders on tort law is limited, and the system of tort law needs to be perfected in order to meet the demand of the society.
