公平问题和权利平等保护问题是恒久的法哲学和法理学问题,只不过在不同的时代和不同的历史发展阶段有不同的表现方式以及人们对其有不同要求。公平问题具有广泛性,它不为任何一种社会科学学科和社会规范形式所垄断,这是由公平问题的本质所决定的。法律作为一种要求社会成员普遍遵循的行为规范对公平问题的关注有其特殊性;公平问题可以体现在社会结构的各个构成上,具体可以分解为社会政治中的公平要求,社会经济中的公平要求,社会文化中的公平要求;公平问题要得到解决,就须将其纳入法制机制中,具体又可分为法律体系中的公平要求和法制运行机制中的公平要求。

As behavior rules requiring social members＇ universally conformity, law shows special concern on the issue of fairness; Fairness embodies in various components of social structure, which can be divided specifically into fairness requirements in social politics, social economy and social culture; To realize fairness in these fields, we should incorporate it into the legal mechanism, which can be further classified into two kinds of specific aspects, that is, fairness requirements in legal system and legal operational mechanism.
