摘要
文物是人类的历史文化遗产,对文物犯罪采取适当的刑罚手段,对于保护文物、维护国家的文物管理秩序意义重大。目前我国文物犯罪刑罚适用中的主要问题有:文物犯罪中刑罚设置的不平衡,死刑适用不当,罚金刑的作用有限等。
Relics are historical cultural heritage of mankind. Proper penalty on relics crime plays an important role in protecting relics and keeping state administrative order on relics. At present, the main problems during the course of applying penalty on relics crime are unbalanced penalty settlement on relics crime, improper death penalty application and limited role of fine sentence.
