有国有资产流失就应要承担相应的法律责任。国有资产流失的法律责任主要包括三个方面:刑事责任、行政责任和民事责任。国有资产流失刑事责任的规定体现了一般保护与特别保护相结合、全面保护与重点保护相结合和平等保护与不平等保护结合。行政责任的规定中要完善"问责"制度,要建立和完善对非国有资产监督、管理和经营者的行政处罚。民事责任中要从监督、管理和经营者及非监督、管理和经营者两个方面来强化。

Where has a loss of state properties there must has any legal liability. The legal liability of the loss of state properties includes three facets ： criminal liability ,administrative liability and civil liability. Rules of the criminal liability reflect some characteristic. It reflects integration of general pretend and special pretend,comprehensive pretend and key pretend,equal pretend and unequal pretend. Rules of the administrative liability shall perfect administrative accountability. We shall establish and perfect the administrative penally. Thinking of civil liability, we shall strengthen the liability of inside and outside of the State - owned Enterprise.
