绿色贸易壁垒的影响及其法律对策

Rational Analysis on Green Trade Barrier and Chinese Legal Countermeasures

随着社会的发展和经济的增长,环境逐渐被作为一种新的贸易资源和贸易产业来认识。绿色贸易壁垒对我国的经济发展和对外贸易有一定的负面效应,也是我国在进出口贸易中面临的较难突破的贸易壁垒。但是,面对全球环境状况的日益恶化,我国也应该理性地思考和辩证地看待国际贸易中的绿色壁垒,绿色贸易壁垒在客观上起到了保护全球生态环境和保护人类和动物生命健康的作用。我国应该加强对绿色贸易壁垒制度的研究,及时采取积极的应对策略,提高我国出口企业的环境竞争力,积极参与环境和贸易领域的国际竞争,不断完善环境管理和绿色保障法律制度,实现我国经济的可持续发展和贸易的生态化。从人类发展的整体和长远利益出发,绿色贸易壁垒对我国推行可持续发展战略,实现贸易与环境良性互动有积极意义。

With the development of the society and the growth of the economy, the environment is gradually regarded as a kind of new trade resource and trade industry. Even though the green trade barrier has the negative influence on Chinese economic development and foreign trade, it is also the trade barrier which is difficult to make a breakthrough. However, facing the increasingly deterioration of the global environmental condition, China should ponder and treat the green trade rationally and dialectically. The green trade barrier plays the role that protects the global ecological environment and the health of human and animals objectively. China should strengthen the study on the green trade barrier system, take the active countermeasure, improve the environmental competitive force of Chinese export enterprises, participate in actively the international competition of the environment and trade area, perfect the environment management and green safeguard legal system continuously, realize Chinese sustainable development of economy and ecological protection. From the point of the entire and long--range interests of human development, the green trade barrier has the active meanings to promote the sustainable development and realize the positive function of trade and environment.
