发生于19世纪中叶的德雷德.斯科特一案是美国历史上最著名的关于宪政和种族平等的众多案件之一,从初审到终审历时10年有余,对美国内战产生了诱导性的作用;它以"1850年妥协案",1854年的《堪萨斯-内布拉斯加法案》和1856年的大选为背景,且共同反映了当时美国社会的某些特征,在一定程度上印证了托克维尔所描述的当时美国多数人统治的一些情况;同时,也反映了多元社会中处理少数人与多数人相互关系的某些值得吸取的经验教训。
Dred Scott's case was one of the best-well known cases on the racial equality and constitutionalism in the history of the US. It took for more than ten years from the first instance to the final trial in the Supreme Court of the US, and it had very strong influences to the history and the roles for resulting the Civil War, 1850 Compromise, Kansas-Nebraska Act and the Election in 1856 were the main background of the case.
