试论云南农村社会养老保险法律制度的完善

On the improvement of the legal System of the rural endowment insurance in Yunnan

农村社会养老保险法律制度是社会保障制度的主要内容。尽管我国宪法和有关法律法规中对农村社会养老保险有一些原则性的规定,但是至今未制定专门的农村社会养老保险的法律。这与中共十七大提出改善民生的理念是不相适应的。本文以云南农村社会养老保险现状为例,从法律的角度探讨农村社会养老保险制度建设的问题,并提出了一些对策。

The legal system of the rural endowment insurance is a part of the social securities. There are a few general articles in our constitution and other law, but there is no one regarding rural endowment insurance. That is not suitable for the policy on the improvement of the people＇s livelihood in the 17th CPC National Congress. This paper begins with the actuality in Yunnan and probes into the issues from the legal perspective. Then, some legislative suggestions are put forward to promote the rural endowment insurance.
