德国离婚中的供给均衡制度研究——兼评最高人民法院相关司法解释的规定

Research on the balance of pension after divorce in Germany——Review on the relevant judicial interpretation of the Supreme People's Court

为了给离婚后经济地位较弱的一方更好的生活保障,德国民法典首创了供给的均衡制度。本文通过对这一制度的介绍与评析,在分析最高人民法院相关司法解释的基础上,提出完善我国相关立法的对策。

In order to provide the better safeguard of the life for one part after divorce who is the weaker in economic status, Germany＇s Civil Code first establishes the system in balance of pension. At first, this paper introduces and analyzes these rules in Germany＇s Civil Code. Then, it reviews the relevant judicial interpretation of the Supreme People＇s Court. Above this base, the author puts forward the countermeasure about how to perfecting the relevant legislation of our country.
