互动性行政行为是指行政主体与行政相对人之间在行政行为的形成、行政行为的过程、行政行为的目的与客观效果的实现的一致性等方面采取互相促动方式,通过制约与激励机制,为实现公共利益与私益的最大化而由行政主体作出或由双方合意而作出的行政行为。按照互动程度不同,互动性行政行为分为成立型、过程型和激励型三种。可接受性原则和信赖保护原则是互动性行政行为的基本原则;互动性行政行为打破了传统的行政行为效力规则,在法律救济途径和承担责任主体等方面具有独立的规则体系。
